Terms of service

Tilda Hosting is committed to providing you with reliable hosting and friendly customer service but we have a few rules we ask you to follow. A bit like the no running around the pool, but more serious.

 

1) We can’t help with everything
Before you read any further it’s important to understand that Tilda Hosting offers website hosting and domain registration services only. We can’t help you develop your website or fix it when something goes wrong. We don’t make tea or have any nice chocolate biscuits. We do have fantastically competitive hosting and domain registration services.

 

2) Additional Policies
The use of Tilda Hosting’s products and services are also governed by the following policies. By using us, you also agree to these policies.

3) Your Account Details
Once your payment has been processed, we will set up your account with Tilda Hosting. It’s up to you to make sure all your contact details with Tilda Hosting are correct, including an email address that isn’t part of the @ domain you’re signing up for.

If you need to verify or change this information, you can do so within the client area or contact our support team. We’re more than happy to help. If you fib about your details and give us false contact information, we reserve the right to terminate your account with Tilda Hosting.

Tilda Hosting will not activate new orders or activate new packages for customers who have an outstanding balance with Tilda Hosting. For a new order to be setup or a new package to be activated, you must have a balance of $0.00, unless otherwise stated by Tilda Hosting in writing.

 

4) Payment Information
As part of your contract of service with Tilda Hosting you agree to supply the agreed payment for the services you receive. That means paying by the due date. We give you more than 10days notice from the time the invoice is generated to when it must be paid.

Tilda Hosting reserves the right to bill your credit card or billing information on file with us. It is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. You agree that until and unless you notify Tilda Hosting of your desire to cancel any or all services received (see the following section on Cancelling your hosting account for details), these services will be billed on a recurring basis.

If your invoice is outstanding for 7 days your account will be suspended until account balance has been paid in full. Access to the account will not be restored until payment has been received.
Any accounts with invoices outstanding for more than 180 days will have their account permanently deleted from Tilda Hosting.

If something happens and your invoice ends up being paid more than once (with multiple Paypal subscriptions) we’ll happily give you a credit for the amount overpaid. Refunds won’t be issued.

Tilda Hosting don’t update our rates very often but we reserve the right to change the monthly payment amount and any other charges at anytime.

 

5) Cancelling your hosting account
You can cancel any or all of the services provided at any time by contacting the support team. Just stopping payment isn’t notification of cancellation and we’ll continue to bill you unless we hear from you in writing. Once we receive your cancellation and have confirmed all necessary information with you via e-mail, we will inform you in writing (typically email) that your account has been cancelled.

Due to the discounts offered, the annual plans offered by Tilda Hosting are not refundable.

6) Coupons
We love first timers, which is why we sometimes offer discounts and coupon. Those discounts and coupon codes are reserved for first-time accounts *or first-time customers* only and may not be used towards the purchase of a domain registration unless otherwise specified. If you have signed up using a particular domain, you may not resign up for that domain using another coupon at a later date. That’s cheating.

If you are found to be in violation of these policies, the appropriate invoices will be added to your account. Coupon abuse will not be tolerated and may result in the suspension or termination of the account. Coupons or discounts are only valid towards the initial purchase, and do not affect the renewal or recurring price.

 

7) Domain renewal
As part of our friendly customer service we will send you domain renewal notices and invoices as a courtesy reminder. Then it’s up to you to act. Tilda Hosting can’t be held responsible for any failure to renew a domain. All domain registrations, and renewals are final. No refunds can be given.

 

8) Content and acceptable use
Tilda Hosting provides services for both business and private users. Our services may only be used for lawful purposes and use of our services to infringe upon any copyright or trademark is prohibited.

As the owner of the hosting account you are solely responsible for all products, contents and materials appearing on your web site including their accuracy and appropriateness. Any account found to be in violation of another person’s copyright will be expeditiously removed, or access to the material disabled. Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from our hosting. We’re serious about this.

Although we’re an Australian business, we use some hosting space in the US. That means that transmission or solicitation of any material that violates Australian and United States federal, state or other laws that may apply in this jurisdiction or your local area is prohibited.

It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. Account holders are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as user name and password. If Tilda Hosting security is breached because of the actions of an account holder, their account will be suspended.

 

9) Bandwidth and disk space
Your disk space usage shall not exceed your allocated number of megabytes per month. This usage is monitored and measured by Tilda Hosting, so we’ll know if you’re cheating. If you regularly go over your usage allocation, we reserve the right to apply additional charges, disconnection or discontinuance of any and all services.

 

10) Uptime Guarantee
The uptime of the Tilda Hosting server is defined as the reported uptime from the operating system and the Web Server, which may differ from the uptime reported by other individual services.

If your shared / reseller server has a physical downtime that is not within the 99.9% uptime you may receive one month of credit on your account. Approval of the credit is at the discretion of Tilda Hosting dependent upon justification provided. Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor’s network capacity/transit availability. All requests must be made in writing via email to our support team.

 

11) Money back guarantee
Tilda Hosting offers a 45 day money back guarantee. If you are not completely satisfied with our services within the first 45 days of your service, you will be given a full refund of the contract amount. This is only for monthly shared or reseller packages and does not apply to dedicated servers, administrative fees, install fees for custom software, or domain name purchases.

12) Backups
While Tilda Hosting have a regular backup schedule, it is your responsibility to backup your own data and files. You agree to take full responsibility for files and data transferred and to maintain all appropriate backups of files and data stored on Tilda Hosting servers. Tilda Hosting accepts no responsibility for any data loss or corruption or the provision of recent backups.

 

13) Service levels
Every now and then Tilda Hosting may interrupt service to perform maintenance activities. We’ll always do our best to inform you of any plans to interrupt service. In the event of an unplanned interruption to service, we will do our very best to repair the system as quickly as possible.

In the event that Tilda Hosting suspects that server security has been breached, we reserve the right to disable the server and/or the account in order to facilitate investigation and recovery. If this action affects you, we will coordinate with you.

 

14) Absolutely No Spam
We hate spam and we take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. “Safe lists”, purchased lists, and selling of lists will be treated as spam. If you send out spam your account will be terminated with or without notice.

Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, phone, postal mail, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account that results in our IP space being blacklisted will be immediately suspended and/or terminated.

Tilda Hosting reserves the right to charge the owner of the account used to send any unsolicited e-mail a clean up fee or any charges incurred for blacklist removal. This cost of the clean up fee is entirely at the discretion of Tilda Hosting.

So no spam, right?

 

15) Indemnification
You agree to indemnify and hold harmless Tilda Hosting, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of Tilda Hosting services, including but not limited to your violation of this agreement.

 

16) Disclaimer
Tilda Hosting shall not be responsible for any damages your business may suffer. You agree to indemnify and hold harmless Tilda Hosting from any claims resulting from the use of our services.

Tilda Hosting makes no warranties of any kind, expressed or implied for services we provide. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Tilda Hosting and its employees.

 

17) Disclosure to law enforcement
Tilda Hosting may disclose any subscriber information to law enforcement agencies (upon lawful request from such agencies) without notifying you or getting your consent. We will always cooperate fully with law enforcement agencies.

 

18) Changes to the Terms of Service (TOS)
Tilda Hosting reserves the right to revise its policies at any time without notice.
